1. General Provisions

1.1 Scope of Application

These terms and conditions apply to both business customers (B2B) and private customers (B2C), unless otherwise specified in individual sections.

1.2 Payment Terms

  • Conveyor systems, cutting machine projects, rental of conveyors, courses and services: Payment is made via invoice with a payment deadline of 14 days unless otherwise agreed in writing.
  • Carrier rental: Paid in advance for the entire period, including deposit if agreed. The rental is only valid upon receipt of payment.
  • Webshop: Payment can be made via Visa, Dankort, MobilePay, Mastercard and other common payment methods. There are no fees for using payment cards.

1.3 Force majeure

ABC Industrigummi ApS is not liable for failure to fulfill its obligations due to force majeure, including but not limited to natural disasters, war, pandemics, strikes, lockouts, transport obstacles, supplier failure or other unforeseen events beyond ABC Industrigummi ApS’ control.

1.4 Data Protection, Cookies, and Privacy Policy

When trading with ABC Industrigummi ApS, your personal data is processed in accordance with our cookie politicy and privacy politicy, which can be found on our website. We use cookies to improve the user experience and for analytical purposes. By using our services, you accept our use of cookies and processing of personal data in accordance with applicable legislation.

1.5 Governing Law and Jurisdiction

All purchases are subject to Danish law. Disputes are settled by the City Court in Roskilde.

2. Purchase of Conveyor Systems

The conditions for purchasing conveyor systems follow the existing “Terms of Sale and Delivery” from ABC Industrigummi ApS. Conveyor systems are delivered according to detailed agreement with the customer, including delivery time, installation conditions and warranty terms.

3. Services (24/7 24-hour service & service agreement)

3.1 Service agreements

By entering into a service agreement, ABC Industrigummi undertakes to perform periodic (semi-annual) service visits and inspections of the customer’s conveyor system in accordance with the selected service package (Standard or Total). The content of the specific agreement is stated in the related offer or contract document.

Service agreements generally run for 12 or 36 months at a time and are prepaid unless otherwise agreed in writing. No refund will be granted in the event of termination in the middle of the period. However, the customer has the option to terminate the agreement in writing no later than 2 months before expiry. If it is not terminated before the deadline, the agreement is automatically extended by 12 months and invoiced.

3.1.1 Geographical delimitation

As a starting point, we only enter into service agreements with customers whose transportation facilities are located a maximum of 500 km away from Ringsted, Denmark.

3.2 Performance and responsibility

Service visits are performed during normal working hours unless otherwise agreed. The customer must ensure access to the plant and operational safety during the service visit. ABC Industrigummi reserves the right to postpone visits in case of force majeure or illness.

ABC Industrigummi is not liable for consequential damages or operating losses, unless this is due to gross negligence on its part.

3.3 24/7 Round-the-clock service

Response is usually the same day and within 24 hours, depending on geographical location and available resources. ABC Industrigummi invoices 24-hour service on an hourly basis with any surcharges outside regular working hours. Customers with a Total Service Agreement have priority access to 24-hour service.

4. Purchase via the webshop

4.1 Application area

These terms and conditions apply to purchases of goods on ABC Industrigummi’s webshop (https://www.abc-industrigummi.dk/shop/) for both business customers (B2B) and private customers (B2C).

4.2 Return Policy

  • Both B2B and B2C customers have a 14-day right of return.
  • The customer covers all costs associated with the return, unless the error is caused by ABC Industrigummi.

4.3 Delivery

  • Standard delivery: Normally within 2-5 business days.

4.4 Shipping costs

  • The customer pays shipping costs when returning goods.

4.5 Complaints

  • The right to complain follows applicable legislation and industry standards.
  • Errors or deficiencies must be reported to ABC Industrigummi within 24 hours of receipt of the order.

5. Ordering projects on cutting machine

5.1 Changes to order

  • The customer can order multiple units, but cannot change the design or dimensions without paying full price for both the original and the new order.

5.2 Payment

  • A start-up fee of DKK 650 is charged for all assignments.
  • 100% prepayment required.
  • Production will only begin after receipt of full payment.

5.3 Defective production

  • The customer bears the risk of error if the stated measurements and specifications are incorrect.
  • ABC Industrigummi bears responsibility if the product does not correspond to the approved drawing.

6. Rental of transportation facilities

6.1 Rental agreement and scope

ABC Industrigummi offers rental of conveyor belts, including belt conveyors with or without catch box. The rental agreement is made in writing and specifies the rental object, rental period, price, delivery method and liability. A standard rental contract is filled out when ordering.

6.2 Rental period and delivery

The rental period is agreed individually and is stated in the contract. The lessee chooses whether the conveyor belt is to be picked up at our address in Ringsted or whether we will arrange delivery for a fee. The same applies to returns. The conveyor belt must be returned in the same condition as when it was delivered, with the exception of normal wear and tear. The condition is documented with a checklist for both collection and return.

6.3 Price and payment

Rent is invoiced in advance and must be paid no later than the day before the start of the rental period. Daily rent, delivery costs and any fees are stated in the specific contract.

6.4 Use and responsibility

The Renter is responsible for the correct use, daily maintenance and cleaning of the conveyor belt. Damage resulting from improper use, negligence or lack of maintenance will be invoiced to the lessee. The lessee is responsible for the equipment throughout the rental period and must at least secure it with valid theft insurance, which must be documented.

6.5 Termination and breach

The rental agreement can be terminated with a minimum of 7 days’ notice by either party. In case of material breach, the agreement may be terminated without notice.
